E‑commerce Policy – Desmond Digital

1. Purpose

This policy governs all payments made on my website for services and products. It ensures compliance with the Electronic Communications and Transactions Act (ECTA), the Consumer Protection Act (CPA), and the Protection of Personal Information Act (POPIA).

2. Payments

  • All payments are upfront and required before services commence.
  • Accepted methods: Credit/Debit Card, Instant EFT, FastPay, EasyPay, PayFast, Peach Payments, Netcash, PayGate.
  • I do not extend credit or allow deferred payments.

3. Banking Details & Security

  • Banking details are provided securely at checkout.
  • I never request sensitive information via email or phone.
  • Payment gateways are PCI‑DSS compliant and use SSL encryption.
  • I am not liable for errors, downtime, or breaches caused by third‑party payment providers.

4. Refunds & Exchanges

  • Refunds or exchanges are governed by my Refund/Exchange Policy (linked separately).
  • No refunds are issued for completed services unless required by law.

5. Liability

  • I am not responsible for:
    • Losses due to payment gateway errors, delays, or fraud.
    • Client dissatisfaction with subjective outcomes (e.g., design preferences).
    • Indirect or consequential damages, including lost income or opportunities.
  • My liability is limited to the value of the transaction paid.

6. Privacy & Data Protection

  • Client information is processed in line with POPIA.
  • Data is used only for service delivery and invoicing.
  • I do not sell or share client data with third parties.

7. Governing Law

This policy is governed by the laws of the Republic of South Africa.
